There is raft of decided case law to the effect that a lack of a signature by the testator or testatrix has never been held to be a complete bar to a document being declared to be a will in terms of s 2(3) of the Wills Act 7 of 1953 whose very object is “to ameliorate the situation where formalities have not been complied with but where the true intention of the drafter of a document is self-evident.”

One questioner had posted an interesting issue as to her right to maintenance out of the estate of her deceased husband. I had suggested to her through law24.com that on the brief facts presented by her, she ought to consult an attorney immediately.
People tend to forget that maintenance is a primary duty owed by one spouse to another. This, I submit is irrespective whether the marriage is monogamous or polygynous. The emphasis is on need and of course whether the estate of the other spouse can afford it.
Of course, where the party seeking support is indigent and his or her spouse is unable through lack of means to meet that obligation such spouse may look to a child with means for support.
