WHAT ARE MY RIGHTS

I lived with a man for ten years who separated from his wife 3 years before me, so they never divorced. He died six months age without a will. What are my rights?

If a person dies without a will their estate is wound up in terms of the Intestate Succession Act 81 of 1987, which you can google and dowload as a pdf. The Act isn't too long or scary, but will definitely answer your questions as to your rights to inheritance.

Essentially, the Act states that where there is no will, the estate of the deceased passes to the deceased's wife and children. If no children are born of the marriage, then the wife gets everything (s1(1)(a)).

You mention that your partner was still married to his wife at the time of his death. This is bad news for you, as his estate will pass to his wife by operation of the Act. There are more intricacies, so feel free to comb through the Act or get a fresh opinion if you are not satisfied with your "lot" here!

I hope this helps

Richard

Verbal contracts and ending emploment
I have recently walked out of my job due to unacceptable working condition ie. Not getting paid on time, violation of personal belongings at work. My employer refuses to pay me my last months salary, I have no written contract.
